Brasil: candidato opositor, contra la liberalización de la marihuana. El candidato del PSDB a la presidencia de Brasil, José Serra, reafirmó su postura en contra de la liberalización de la marihuana. Según su opinión, “la marihuana no es muy diferente de alcohol. Una cosa es cierta: es un paso en esa dirección. Y hoy no tenemos una estructura social, un gobierno eficiente, un sistema de salud capaz de enfrentar una situación de tal complejidad”. Serra advirtió además que “el 80% de la droga que llega a Brasil proviene de Bolivia y Colombia. El gobierno brasileño tiene que trabajar con estos países y proteger nuestra frontera. Argentina: la Justicia condenó el uso de marihuana en la calle. En un fallo dividido, la Justicia volvió a penalizar el consumo de marihuana en la vía pública, considerando “la posible afectación a la salud pública en atención al lugar donde se desarrolla la conducta”. Lo determinó la Sala II de la Cámara Nacional en lo Criminal y Correccional Federal, al confirmar un fallo de primera instancia que había sido apelado por el abogado defensor de una persona acusada por tenencia de estupefacientes para uso personal. Bolivia: Evo Morales acusa a EE.UU. de sabotaje en la lucha antidrogas. El presidente de Bolivia Evo Morales denunció que Estados Unidos sabotea la lucha contra el tráfico ilícito de drogas que realiza su gobierno, para acusarlo de narcotraficante dentro de sus intereses geopolíticos para controlar los recursos naturales. “En estos momentos, el Gobierno boliviano soporta un sabotaje permanente de la lucha contra el narcotráfico de parte del Gobierno de Estados Unidos. ¿Qué quiere? Brasil: Apelan condena a militar brasileño condenado por fumar marihuana. La Defensoría Pública presentó un Habeas Corpus ante el Supremo Tribunal Federal (STF) en el cual pide la anulación de la condena o la absolución de un cabo que fe sorprendido fumando un cigarrillo de marihuana. Juzgado en primera instancia, el suboficial fue condenado a un año de prisión en virtud del artículo 290 del Código Penal Militar. El Superior Tribunal Militar (STM) confirmó la condena. Según la Defensoría, el artículo del Código Penal Militar, que define como “delitos contra la salud” poseer narcóticos, incluso para el consumo personal, es inconstitucional e incompatible con los convenios internacionales ratificados por el Brasil. México: Permiten en Hidalgo posesión de marihuana para uso inmediato y personal. Diputados de Hidalgo aprobaron por unanimidad la posesión hasta de cinco gramos de marihuana para uso inmediato y personalísimo, como parte de la homologación de normas estatales a la Ley General de Salud aprobada por el Congreso de la Unión el 20 de agosto pasado. Esta disposición señala que portar de 5.1 gramos a cinco kilos de cannabis será considerado narcomenudeo, y de cinco kilogramos en adelante, narcotráfico, informó el legislador priista Pedro Luis Noble Monterrubio. Aseguró que no se promueve el consumo de drogas, pues ello contravendría la lucha del Estado mexicano contra el narcotráfico. La Jornada, México, 28-07-10. La penalización de los consumidores de drogas ilícitas fomenta la epidemia del VIH. Esa es la principal conclusión que puso de manifiesto la Declaración de Viena, impulsada por los participantes de la XVIII Conferencia Internacional sobre SIDA (SIDA 2010). El documento elaborado por expertos y avalado por la Sociedad Internacional sobre SIDA, el Centro Internacional de Ciencia en Políticas de Drogas y el Centro de CB para la Excelencia en VIH/SIDA advierte que “se necesita una completa reorientación de la política”, ya que la actual ha provocado “consecuencias sociales y de salud tremendamente negativas”.
