Discurso de Apertura de la II Conferencia Latinoamericana sobre Políticas de Drogas
“Hay un nuevo discurso sobre drogas en la región, el desafío es que se convierta en políticas que lleguen a la gente”
Las palabras de Graciela Touzé, Presidente de Intercambios Asociación Civil, dieron comienzo a la II Conferencia Latinoamericana y I Conferencia Brasileña sobre Políticas de Drogas que se lleva a cabo en el Noble Salón de la Facultad de Derecho de la Universidad Federal de Río de Janeiro. A continuación se reproduce su discurso.
Permítanme transmitirles mi enorme alegría por estar hoy inaugurando esta II Conferencia Latinoamericana y I Conferencia Brasileña sobre Políticas de Drogas, aquí, en esta ciudad maravillosa que es Rio de Janeiro.
Nos acompañan muchos viejos amigos, funcionarios de gobierno, de agencias multilaterales, expertos, activistas, que han participado en años anteriores de las Conferencias que organizamos en Buenos Aires. Para quienes por primera vez se acercan a este espacio, permítanme contarles algo de la historia de la Conferencia, y de cómo llegamos hasta aquí.
En el año 2003, desde la Asociación Intercambios, decidimos que en nuestro país, Argentina, era necesario inaugurar un foro para discutir acerca de las políticas en materia de drogas, teniendo en cuenta las transformaciones en el contexto, el efecto de las políticas implementadas y la crisis de algunos paradigmas de intervención en el tema.
Convocamos entonces a decisores políticos, a académicos, a la sociedad civil, a un debate que rápidamente comenzó a mostrar la necesidad de encontrar nuevas formas de regulación al problema de las drogas y de incorporar la perspectiva de los derechos humanos.
En los años subsiguientes se sucedieron seis Conferencias Nacionales, y en cada una de ellas, la presencia de participantes de países hermanos de Latinoamérica y de otras regiones, nos fue mostrando el interés y la necesidad de establecer un mecanismo de encuentro y diálogo que permitiera poner en escena las diversas realidades y experiencias de nuestra América Latina.
Fue así que el año pasado, vimos oportuno organizar la I Conferencia Latinoamericana sobre Políticas de Drogas, con la intención de promover una acción planificada y coordinada en la región, que represente una posición más adecuada a las necesidades y prácticas culturales de nuestras poblaciones.
Y ahí echó a andar la idea: tener un espacio anual de reunión para profundizar estos debates y para establecer alianzas estratégicas de trabajo y cooperación. Y al mismo tiempo, ir replicando estos foros en los distintos países de la región.
El sueño de una iniciativa regional comenzó a concretarse cuando los amigos de Psicotropicus aceptaron el desafío de co-organizar la II Conferencia Latinoamericana en Rio de Janeiro, la que esperamos, sea un hito en un largo camino por recorrer.
2009 en Buenos Aires, 2010 en Rio de Janeiro, los mismos objetivos:
- Propiciar un debate social informado con miras a impulsar políticas no punitivas, fundadas en evidencia científica, que respondan y atiendan los diversos problemas asociados con las drogas, y
- Generar un intercambio a nivel regional entre académicos, decisores políticos y sociedad civil, a fin de mantener actualizado el mapa sobre el consumo de drogas, problemas asociados, políticas e intervenciones en la región.
Estos propósitos han orientado el programa de la Conferencia, estructurado en torno a 7 ejes.
El primero, los derechos humanos, porque queremos hacer hincapié en el hecho de que las personas que usan drogas ilícitas enfrentan situaciones de discriminación, rechazo y violencia que conducen a violaciones de sus derechos. Muchos de estos incidentes se ocultan o se justifican, bajo el argumento de la “peligrosidad” o la “incapacidad” de los usuarios de drogas, culpándolos así de los abusos a los que son sometidos. No es posible seguir tolerando estas situaciones.
El segundo es la agenda de los organismos multilaterales, y qué lugar ocupan en ella los usuarios de drogas. Los organismos multilaterales constituyen un actor clave en el desarrollo de las políticas en la región, aportando a la construcción de la agenda pública mediante sus programas de asistencia técnica y financiera. Tanto la Asamblea General de las Naciones Unidas como varias de las agencias de su sistema han elaborado una serie de resoluciones, declaraciones y documentos orientadores de la atención a los usuarios de drogas en el marco de la salud pública y el respeto a los derechos humanos. Sin embargo, vemos con preocupación que sus acciones no son suficientes ni sistemáticas en América Latina, y reclamamos mayor atención y prioridad para estas poblaciones.
El tercer eje son las políticas socio-sanitarias. Un aspecto importante del debate actual sobre la reforma de las políticas de drogas se articula en torno al derecho a la salud como cuestión indisociable del respeto de los derechos humanos fundamentales. Los avances observados en la región tendientes a evitar la persecución penal de los usuarios de drogas exigen un claro protagonismo de las políticas sociales y sanitarias, y nos preguntamos cómo reducir la brecha existente entre los discursos innovadores y respetuosos de los derechos humanos y la efectiva implementación de políticas en materia de drogas.
El cuarto eje examina las fuerzas estructurales y los contextos socioculturales para comprender la particular situación de vulnerabilidad de los usuarios de drogas. La complejidad del fenómeno de las drogas y sus múltiples facetas incluyen aspectos como la producción y el tráfico de drogas, el papel de las fuerzas armadas, la corrupción política, entre otros. Asimismo, es menester encuadrarlo en un escenario más amplio que tome en consideración aspectos estructurales de las sociedades latinoamericanas, caracterizadas por condiciones de pobreza e inequidad, y que contemple la interacción con las políticas sociales y económicas llevadas adelante en la región.
El quinto eje se orienta hacia la atención integral a los usuarios de drogas, la que entendemos como el desarrollo de estrategias comprehensivas, complementarias y multisectoriales que se ocupen de la prevención, la asistencia por el consumo problemático, la reducción de los daños y la integración social. Sabemos de las dificultades que las poblaciones más afectadas continúan sufriendo en nuestra región para acceder a servicios de calidad.
El sexto eje se centra en las consecuencias que ha traído aparejado el paradigma de la guerra contra las drogas, consecuencias que agravaron los problemas en la región: cárceles atestadas, lavado de dinero, aumento de la pobreza e inseguridad de poblaciones campesinas por la erradicación forzada de cultivos, problemas ambientales y de salud debidos a fumigaciones aéreas, entre otros.
Y por último, la esperanza que encarnan las reformas legislativas que se están discutiendo en varios países de la región, y que incluyen entre otros, aspectos tales como la proporcionalidad en las sentencias y la aplicación de estándares de derechos humanos en la legislación y en la práctica judicial.
Estamos seguros que el nutrido grupo de panelistas que nos acompañarán estos dos días - a quienes agradezco infinitamente su disposición - no sólo enriquecerán este debate sino que nos brindarán además orientaciones concretas para la acción.
Porque esta Conferencia constituye un polo de discusión progresista que apunta a fortalecer los procesos de reforma de las políticas de drogas.
Es cierto que son muchos los signos alentadores en la región pero también es cierto que son muchos los desafíos que aún debemos enfrentar. Debemos reconocer que el cambio discursivo que implica reconocer el fracaso de la guerra contra las drogas aún no se ha traducido en políticas concretas que lleguen a la gente. Debemos insistir en la necesidad de instalar políticas de seguridad no represivas; nuestros países conocen demasiado bien las consecuencias funestas de la militarización de los conflictos, como las que hoy está viviendo México. Y debemos, de una vez y para siempre, instalar políticas de Estado a largo plazo que no estén sujetas a vaivenes electoralistas.
Creemos que esta Conferencia ocupa un espacio inédito en América Latina: expandir una masa crítica que alce una voz alternativa a la que por tanto tiempo se erigió como hegemónica.
