II Conferência Latino-Americana sobre Políticas de Drogas
Para uma política de drogas adequada, faz falta um enfoque que respeite os Direitos Humanos
No marco da II Conferência Latino Americana e I Conferência Brasileira sobre Políticas de Drogas que está acontecendo no Rio de Janeiro, foi realizado o painel denominado Direitos Humanos e Políticas de Drogas, que teve como palestrantes especialistas e políticos importantes de diversos países
(Rio de Janeiro, 26 de agosto de 2010) A Conferência Latino Americana sobre Políticas de Drogas começou. Logo depois da abertura do encontro, foi iniciado o painel sobre Direitos Humanos e Políticas de Drogas, onde participaram Pedro Vieira Abramovay, Secretário Nacional de Justiça do Ministério de Justiça do Brasil, Jorge da Silva, membro da Comissão Brasileira sobre Drogas e Democracia e ex-Secretário de Estado de Direitos Humanos do Rio de Janeiro (2003-2006), Claudio Morgado, Presidente do Instituto Nacional contra a Discriminação, a Xenofobia e o Racismo (INADI) do Ministério de Justiça, Segurança e Direitos Humanos da República Argentina, e Kasia Malinowska-Sempruch (Polônia), Diretora do Programa Global sobre Políticas de Drogas do Open Society Institute (OSI). O moderador foi Rubem Cesar Fernandes, diretor executivo do Viva Rio e secretário executivo da Comissão Brasileira sobre Drogas e Democracia.
Segundo afirmou Pedro Vieira Abramovvay, “a legislação brasileira superou o preconceito, mas ainda tem deficiências evidentes. As pessoas que vão presas em 70% dos casos estão desarmadas, não têm nenhum vínculo com o crime organizado e estavam sozinhas. Então, apesar da nova lei, acaba-se penalizando de maneira severa as pessoas que não são traficantes”.
“Há um limite entre o tráfico e consumo. Entretanto, uma pessoa que vai ser considerada ao final como consumidora, se a polícia diz no início do processo que era narcotraficante, terá de estar presa durante todo o processo. E assim, uma pessoa que não tinha vínculo antes com o crime organizado, passará a tê-lo na prisão em virtude de uma violação dos Direitos Humanos. Esse é um debate proibido dentro do debate. Por isso essa Conferência é importante, porque põe o dedo na ferida e enfrenta o problema de frente”.
Contra as políticas repressivas
Por sua vez, Jorge da Silva relatou sua experiência na Polícia Militar e como foi descobrindo que as políticas repressivas não constituem a maneira adequada de abordar o tema de drogas. “Em meus tempos de Polícia Militar, eu achava que os usuários de drogas deviam ser reprimidos igual aos traficantes. Agora mudei de opinião, disse.
Logo se referiu à experiência de Portugal, que implementou algumas medidas despenalizadoras em 2001. “Todos achavam que haveria um aumento total do consumo - destacou Da Silva. E isso não aconteceu. Tendo em conta que o objetivo das políticas globais da guerra contra as drogas era acabar com as drogas, teria que pensar que realmente não são pessoas ingênuas”.
Por fim, manifestou seu “apoio de forma radical” às campanhas de descriminalização da maconha porque “por algum lado temos que começar”.
O estigma do “viciado”
Claudio Morgado se manifestou contra o enfoque que toma os aspectos sociais como fatores de risco e como parte constitutiva do problema. Explicou, ainda, que “o estigma do ‘viciado’ tira da pessoa sua identidade: homem, mulher, amigo, amante. A consequência disso é uma abordagem que favorece a exclusão social”.
O funcionário argentino advogou pelo “reconhecimento das pessoas usuárias com uso problemático de drogas legais e ilegais como sujeitos de direitos. As políticas públicas, estratégias e ações devem favorecer sua autonomia e respeito aos Direitos Humanos”.
Por último, disse que o organismo que dirige, o INADI, “apóia o projeto de lei de saúde mental que tem meia sanção, que em seu artigo 4 diz que as pessoas usuárias de drogas tem todos os mesmos direitos de todas as demais contempladas na lei. É uma legislação não discriminatória que esperamos que avance”.
Saúde Pública e redução de danos
Kasia Malinowska-Sempruch apontou que “quando pensamos em políticas sobre drogas, não pensamos apenas em políticas de justiça criminal. É importante termos consciência que a questão envolve também a saúde pública e a redução de danos. Quando falamos políticas de drogas, também falamos de outras questões relacionadas”.
“Não podemos nos focar em políticas baseadas na abstinência. Se a abstinência é o único resultado desejado, não teremos acesso à metadona, por exemplo. Não importa que o tratamento com metadona permita que os usuários de opióides voltem a trabalhar, não importa se reduz o sofrimento dos familiares, não importa se abre portas para o usuário: como a metadona não leva à abstinência, não será oferecida em tratamentos”, destacou.
