Painel: Reformas legislativas na América Latina
Dos regimes especiais à proporcionalidade das penas
Em vários países da região, estão sendo discutidas reformas legislativas referente às drogas. Durante o painel “Reformas legislativas na Amércia Latina”, o vice-ministro de Justiça do Equador, a fiscal e responsável pela comissão do governo argentino que trabalha com o tema de drogas, um representante da Corte Suprema do Uruguai e um deputado federal brasileiro concordaram que faltam reformas legais que incorporem a proporcionalidade nas sentenças, a diferenciação entre crime organizado e microtráfico e a aplicação de padrões de Direitos Humanos
(27/08/10 16h30 a 18h00) No painel “Reformas legislativas na América Latina”, chegou-se a um diagnóstico comum: a legislação vigente em matéria de drogas criou novos delitos, fez rupturas no tecido social e destruiu o meio ambiente. Em síntese, gerou Estados favoráveis à violação dos Direitos Humanos. A partir dessa visão em comum, o vice-ministro de Justiça do Equador, Freddy Pavón Rivera, a secretária executiva da Comissão Nacional Coordenadora de Políticas Públicas em Matéria de Prevenção e Controle do Tráfico Ilícito de Entorpecentes, do Crime Organizado Transnacional e da Corrupção da Argentina, Mónica Cuñarro, o Ministro da Suprema Corte de Justiça do Uruguai, Jorge Ruibal Pino, e o deputado federal do Brasil, Paulo Teixeira, apresentaram um panorama sobre as reformas legislativas em seus países. A moderação da mesa esteve a cargo de Ricardo Soberón Garrido, diretor do Centro de Investigação Drogas e Direitos Humanos do Peru.
Equador: acabar com o regime especial
“Na maioria dos países da região, as leis sobre drogas são regimes especiais, o que quer dizer que são de caráter excepcional e isso vai de encontro às garantias fundamentais dos processados, pois as penas são desproporcionais e as prisões estão cheias de mulas presas no sistema carcerário, e não de grandes traficantes”, afirmou Freddy Pavón Rivera, vice-ministro de Justiça do Equador no painel sobre Reformas Legislativas na América Latina, mesa que encerrou a II Conferência Latino-Americana e I Conferência Brasileira sobre Políticas de Drogas.
“É um desafio desenhar uma política de drogas, porque é um tema sensível, os Estados não têm liberdade absoluta. Chama a atenção que o mesmo organismo que promove os Direitos Humanos promove a guerra contra as drogas”, destacou o vice-ministro equatoriano, em uma crítica velada a algumas das agências das Nações Unidas.
“Não se pode curar castigando nem castigar curando”, destacou a autoridade, que afirmou que “a legislação de drogas recai sobre as pessoas mais frágeis da sociedade, que não por acaso são as mais pobres” e anunciou que o Equador está avançando em uma reforma da lei de drogas. “Nosso projeto de lei foi concebido a partir do conceito de que a lei de drogas não deve ser especial, mas sim dentro do sistema penal e respeitar os princípios de proporcionalidade, devido processo etc. Significa que as penas mais severas serão usadas somente para penalizar o tráfico internacional, e as menos severas, o microtráfico”, concluiu.
Argentina: UNASUL como plataforma
“Todos os países da América Latina são signatários dos principais instrumentos internacionais para a defesa dos Direitos Humanos, mas a prática dos Estados não garante esses direitos”, reconheceu a argentina Mónica Cuñarro.
A secretária executiva da Comissão Nacional e Coordenadora de Políticas Públicas em Matéria de Prevenção e Controle do Tráfico Ilícito de Entorpecentes, o Crime Organizado Transnacional e a Corrupção comparou em “antes e depois” as legislações das décadas de 80 e 90 com as que começaram a ser sancionadas no ano 2000. Destacou que, antes, “por influência estrangeira, especialmente do ex-presidente Ronald Reagan, tínhamos legislações que permitiam derrubar aeronaves que invadiam o espaço aéreo”, e que, desde a virada do século, começaram a ser impulsionadas “reformas tanto constitucionais como de leis orientadas ao respeito dos princípios de legalidade, proporcionalidade das penas e devido processo”.
Cuñarro destacou que “isso é compartilhado pela maioria das novas legislações na América Latina” e considerou que “deve-se aproveitar a UNASUL como uma janela para encontrar consensos para avançar na defesa dos Direitos Humanos, pois há mais coisas que nos unem que coisas que nos separam. Os Direitos Humanos não serão dados pelos legisladores, é preciso lutar por eles e construí-los como ocorreu depois da II Guerra Mundial”.
Uruguai: das leis aos fatos
“Uma boa legislação sobre drogas não é garantia de justiça nem de respeito aos Direitos Humanos, advertiu Jorge Ruibal Pino, ministro da Suprema Corte de Justiça do Uruguai, país que desde 1974 tem uma lei em que o usuário está isento de pena por posse mínima para consumo pessoal. “Realmente esse tem sido um amplo processo da sociedade em construir os mecanismos para garantir os direitos das pessoas”, afirmou.
Um dos recursos mais úteis para isso no Uruguai foi a criação da Mesa Interinstitucional “onde estão representados diferentes setores da sociedade, inclusive as pessoas que trabalham no dia a dia com os usuários de drogas, como o Instituto para a Infância e Adolescência do Uruguai, com o qual se desenharam os dispositivos de atenção”, destacou o juiz.
Brasil: rumo a uma nova lei
Por fim, o deputado federal especialista em drogas, Paulo Teixeira, impulsor do primeiro projeto de lei sancionado em São Paulo sobre o tema, destacou os estudos que foram apresentados ao largo da II Conferência Latino-Americana e I Conferência Brasileira sobre Políticas de Drogas, que revelam que as pessoas privadas de sua liberdade por delitos associados às drogas são em sua maioria homens jovens, detidos em via pública, com doses mínimas, sozinhos, desarmados e sem vínculos com o crime organizado.
“Tudo isso significa que faz falta uma reforma da lei de drogas, que em seu espírito é progressista, mas não basta para diferenciar os grandes traficantes de quem consome ou está no varejo”, concluiu.
