Conclusiones y Perspectivas
Los días 8 y 9 de septiembre se desarrolló en la ciudad de Buenos Aires, la II Conferencia Nacional sobre Políticas de Drogas, organizada por Intercambios Asociación Civil con el apoyo del Fondo para la Reforma de las Políticas de Drogas, administrado por la Tides Foundation de Nueva York. Este encuentro se realizó en el Salón Auditorio de la Honorable Cámara de Diputados de la Nación, y reunió a más de 350 participantes entre legisladores, jueces, decisores políticos, profesionales del sistema judicial, y de instituciones de salud, representantes de ONGs y usuarios de drogas. Esta conferencia fue declarada de interés por las Cámaras de Senadores y Diputados de la Nación y fue auspiciada por el Ministerio de Salud y Ambiente de la Nación, la Secretaría para la Prevención de la Drogadicción y Lucha contra el Narcotráfico (SEDRONAR), la Organización Panamericana de la Salud (OPS), el Programa Conjunto de las Naciones Unidas para el SIDA (ONUSIDA), la Oficina de las Naciones Unidas para la Droga y el Delito (ONUDD), entre otros organismos nacionales e internacionales.
Intercambios es una ONG que trabaja desde casi una década en problemas relacionados con las drogas y en esta oportunidad introdujo este debate en el más alto nivel del ámbito legislativo.
En el panel de apertura, la presidenta de Intercambios, Graciela Touzé, señaló que “sobre este tema se aplican políticas que no sólo no ayudan, sino que agravan la problemática. Por eso le pedimos al Estado y nos ofrecemos a colaborar en una alianza con la sociedad civil para implementar y pensar nuevas alternativas, y modificar las normas para poder implementar políticas”. “No hay aún una política clara contra la droga” dijo el Dr. José Ramón Granero, Secretario de Estado de la Secretaría para la Prevención de la Drogadicción y Lucha contra el Narcotráfico (SEDRONAR), quien agregó que “desde 1989 hay un decreto presidencial que ordena la realización de un plan nacional contra la droga”. En la apertura hablaron también la presidenta y vicepresidenta primera de la Comisión de Prevención de las Adicciones y Lucha contra el Narcotráfico de la Honorable Cámara de Diputados de la Nación, las Diputadas María Teresa Ferrín y Marta Osorio.
En la conferencia se trataron temas como el contexto socio cultural del fenómeno de las drogas en un panel integrado por el sociólogo Alberto Calabrese, la filósofa Ester Cohen, el periodista Pedro Lipcovich y el filósofo León Rozitchner. El Lic. Calabrese (asesor institucional del Fondo de Ayuda Toxicológica) sostuvo que “la lucha contra la sustancia es absurda, hay que diseñar una política clara y activa para que la gente no se drogue. Y cuando hay usuarios que lo hacen a pesar de todo, hay que pensar seriamente en políticas de reducción de daños”.
Por su parte, en el panel sobre legislación nacional, la senadora Diana Conti presentó su proyecto de ley que modifica los artículos 5, 14, 19 y 20 y deroga los artículos 17, 18, 21 y 22 de la Ley 23.737. El proyecto considera que la penalización de la tenencia es una forma encubierta de penalizar el consumo, violando así expresamente el principio de reserva establecido por el artículo 19 de la Constitución Nacional. A su vez, la Dra. Matilde Bruera, defensora pública oficial ante el Tribunal Federal Nº 2 de Rosario, enfatizó estas consideraciones.
El diputado nacional Francisco Sellarés también declaró su apoyo a la despenalización de la tenencia de drogas para consumo personal y a los proyectos que incluyen políticas de reducción de daños. La necesidad de incluir esta perspectiva de trabajo en las políticas públicas fue asimismo remarcada por la diputada nacional Juliana Marino.
El juez de la Cámara Federal de Apelaciones de Paraná, Dr. Enrique García Vitor, afirmó que “la guerra a las drogas es una política equivocada”. Añadió que “tenemos que bajar el consumo de tóxicos desde el sistema educativo. Hay países que no penalizan la tenencia para consumo personal, como es Uruguay, y cuando uno va advierte que no hay allí más consumo ni mafia más grande que aquí. Si el sistema penal me tiene que venir a contar a mí lo que hace mi hijo es una vergüenza para mi calidad de padre”. Por su parte, la diputada nacional María Fabiana Ríos dijo que “si bien en Argentina asumimos el tema de las drogas, nos olvidamos que detrás de las drogas hay un sujeto con sus propios problemas y angustias”. Además agregó que “no podemos perder de vista la cuestión de las drogas legales, de las drogas que se venden en la farmacia.”
El Dr. Alain Labrousse, fundador del Observatorio Geopolítico de Drogas e invitado de Francia, cerró el primer día de la conferencia. “Los intereses geopolíticos entran en contradicción con la voluntad proclamada de los estados para combatir la droga” dijo Labrousse y agregó: “La relación entre poder y mafias del narcotráfico es clara en México; en la Argentina no es muy distinto, el affaire Yabran, por ejemplo, no está aclarado. Además, si los EE.UU. y Europa no señalaron la corrupción del gobierno de Menem es claro que eso se debe a que llevaba a cabo una política neoliberal que beneficiaba a sus empresas”.
En el segundo día de la conferencia, el Dr. Gerry Stimson (Gran Bretaña), Director Ejecutivo de la Asociación Internacional de Reducción de Daños, expresó que “la reducción de daños no culpa a las personas. Tal vez no esté de acuerdo con lo que están haciendo, pero intenta entender la situación del individuo y mantener el respeto por esa persona.”
En el panel sobre las drogas en la agenda de las políticas públicas, el Prosecretario de la Presidencia de la República y Presidente de la Junta Nacional de Drogas de Uruguay, Dr. Leonardo Costa, señaló: “Los países a veces vemos el delito como el centro del tema, y creo que el consumo de drogas no es un tema para el Ministerio del Interior sino para el Ministerio de Salud. En mi país la tenencia para consumo no está considerada un delito sino una conducta despenalizada y eso permite hacer intervenciones sanitarias”.
El Dr. Camilo Verruno, Subsecretario de Prevención y Asistencia de la SEDRONAR, anunció que “a partir de visitas de expertos internacionales y las experiencias de reducción de daños, la SEDRONAR va a abrir un foro de discusión donde se incorporará la discusión sobre reducción de daños. Después de este consenso va a ser dada una posición oficial”.
El diputado brasileño Paulo Pimenta, autor del proyecto de ley 7134 de modificación a la ley de drogas de Brasil, contextualizó la elaboración de esa ley en el marco del proyecto del gobierno de Lula “que intensificó las discusiones para revisar legislación desde las perspectivas de la inclusión y plena ciudadanía”. En ese contexto relató que se dedicó a “coordinar los proyectos de ley para unificarlos en una nueva ley sobre drogas, de 73 artículos, mediante un debate en la sociedad y siete áreas del gobierno”. La ley propuesta por Pimenta fue aprobada por la Cámara de Diputados y espera sanción del Senado. “Esta ley distingue usuarios, por un lado, y traficantes, por otro, y propone penas para los primeros, pero no de cárcel” señaló el legislador.
En el panel denominado “Políticas de Control” el Dr. Ricardo Rojas, Juez de la Capital Federal, señaló que “la estigmatización del adicto como delincuente contraría la intención que se persigue, que es recuperarlo para la sociedad”. El Lic. Germán Montenegro, Sub-Director del Programa de Investigación sobre Fuerzas Armadas, Seguridad y Sociedad (Universidad Nacional de Quilmes) aseguró que “estamos en un momento histórico, el Estado está empezando a retomar la capacidad de intervención en estos temas”.
Para el abogado Dr. José Stefanolo “la actitud que toma un país en relación con la droga muestra que tipo de país es. Creo que el tema [del uso de las drogas] tiene que estar en la justicia civil, pero no en la penal, porque ahí no se vive el infierno de la droga sino el infierno de la cárcel”. En esa mesa, el psiquiatra Alfredo Grande comentó: “Si alguien utiliza una droga y solo se perjudica a sí mismo, el remedio no puede ser peor que la enfermedad. La estigmatización es un ataque a la salud mental”.
En el cierre del segundo y último día, Pablo Cymerman, de Intercambios Asociación Civil, cerró la jornada afirmando: “Las actuales políticas de drogas requieren una revisión profunda; han demostrado no sólo su insuficiencia para responder adecuadamente a las diversas necesidades producto de los cambios en el contexto social del uso de drogas, sino que además han demostrado su carácter iatrogénico”. Además insistió en “reflexión y acción, acción que permita trascender el plano discursivo y poner en ejercicio nuevas formas de responder a los problemas asociados a las drogas, sin las actuales secuelas de criminalización y aislamiento”.
