“El peso de la ley debe estar orientado al crimen organizado, no a los eslabones más bajos ni a los consumidores”
-Se realizó en Brasil la II Conferencia Latinoamericana de Políticas de Droga y la ONG Intercambios estuvo presente, ¿cuáles fueron los ejes de trabajo?
-Hubo siete ejes, uno vinculado al tema de la droga y los derechos humanos, otro sobre políticas sociosanitarias en esta temática, otro eje fue la atención integral de los usuarios de drogas, hubo un panel que trabajó los determinantes estructurales (aspectos que tienen que ver con el contexto sociocultural, político y económico) que afectan los problemas asociados con las drogas. En otro panel se trabajaron las reformas legislativas que se están discutiendo y avanzando en varios países, otra de las mesas reunió a varios expertos que plantearon las diversas consecuencias que emergen del paradigma de la guerra contra las drogas. También se presentó una guía sobre políticas de drogas que se plantea como una orientación para que los tomadores de decisiones puedan tener alternativas a las políticas vigentes.
-¿Hay escenarios diferentes si uno hace una línea divisoria entre lo que es narcotráfico y lo que puede ser un microtráfico? ¿Se tiene que trabajar con políticas diferentes?
-Hubo una orientación que señaló la necesidad de cambiar lo que en la actualidad viene siendo en la mayoría de los países una persecución centrada en los eslabones más débiles del tráfico y en los propios consumidores de drogas. Lo que se planteó es que esto debe modificarse y ese peso, el control y aplicación de la ley, debe estar orientado al crimen organizado, a los grandes intereses involucrados en el narcotráfico y no en estos sectores.
-¿Hoy en Latinoamérica las políticas en general tratan del mismo modo a un consumidor de marihuana que, por ejemplo, a todo un grupo armado en una favela brasileña?
-Respecto del tratamiento penal de los consumidores de droga hay ciertas diferencias en la región. Hay países como Uruguay que nunca ha penalizado la tenencia para uso personal; tenemos nuestro país con una ley que sí penaliza la posesión para uso personal, pero con un fallo de hace un año que declaró inconstitucional esta situación; Brasil modificó su ley de drogas en el 2006, donde la tenencia para uso personal continúa siendo un delito pero no se le aplican penas de prisión, y por otro lado, tenemos la situación de Colombia, que no tenía penalizada la tenencia para uso personal y que recientemente dio marcha atrás y volvió a penalizarla. Lo que se viene observando es una tendencia a corregir este hecho de poner en un plano de igualdad situaciones de delitos con situaciones que tienen que ver con la conducta de personas.
