Concluyó la II Conferencia Latinoamericana sobre Políticas de Drogas
En políticas de drogas América Latina va por delante de los Estados Unidos
Con un fuerte debate sobre cómo la ilegalidad del mercado de las drogas alimenta al negocio del narcotráfico, ya que la prohibición lleva a que el kilo de cocaína tenga un valor de U$S 1600 en Colombia y se venda a U$S 97 mil en el menudeo en Estados Unidos, concluyó hoy la II Conferencia Latinoamericana sobre Políticas de Drogas en Río de Janeiro. Representantes de gobiernos y expertos de trece países de la región debatieron reformas legislativas para despenalizar al consumo, diferenciar al microtráfico del crimen organizado y avanzar en estrategias de reducción de daños.
(Río de Janeiro, 27 de Agosto de 2010; 18:30 Hs) “En la mayoría de los países de la región las leyes sobre drogas son regímenes especiales, lo que quiere decir que son de carácter excepcional y esto va en desmedro de las garantías fundamentales de los procesados, porque las penas son desproporcionada y las prisiones están llenas de mulas atrapadas en el sistema carcelario y no de grandes traficantes”, afirmó Freddy Pavón Rivera, viceministro de Justicia del Ecuador en el cierre de la II Conferencia Latinoamericana y I Conferencia Brasilera Sobre Políticas de Drogas, que organizada a nivel local por Psicotropicus de Brasil y a nivel regional por Intercambios de Argentina se realizó ayer y hoy en el Salón Noble de la Facultad de Derecho de la Universidad Federal de Río de Janeiro.
“Es un desafío diseñar una política de drogas porque es un tema sensible, los estados no tienen libertad absoluta. Llama la atención que el mismo organismo que promueve los derechos humanos promueve la guerra contra las drogas”, señaló el vice ministro ecuatoriano en una crítica velada a algunas de las agencias de las Naciones Unidas. Fue durante el panel sobre “Reformas Legislativas en América Latina”, donde se coincidió en que “la legislación vigente ha creado nuevas delincuencias, ha hecho trizas el tejido social y ha destruido el medio ambiente”.
Para revertir esto, la fiscal argentina Mónica Cuñarro, secretaria ejecutiva de la Comisión Coordinadora de Políticas Públicas en Prevención y Control del Tráfico Ilícito de Estupefacientes, la Delincuencia Organizada Transnacional y la Corrupción de la Jefatura de Gabinete de la Argentina propuso “aprovechar UNASUR como una ventana para encontrar consensos sobre cómo avanzar en políticas de drogas desde la defensa de los derechos humanos”. Por su parte, el mismo panel, el ministro de la Suprema Corte de Justicia del Uruguay, Jorge Ruibal Pino advirtió que “una buena legislación sobre drogas no es garantía de justicia ni respeto a los derechos humanos”.
U$S 320 mil millones al año
Según datos de las Naciones Unidas, el tráfico anual de drogas ilícitas mueve U$S 320 mil millones de dólares. “El problema de las drogas es económico y, aunque sus causas tienen diversas facetas, la solución al tema económico es lo que va a destrabar la discusión”, afirmó Juan Carlos Hidalgo, coordinador de Proyectos para América Latina del Centro para la Libertad y Prosperidad Global (Cato Institute) de Washington. Hidalgo hizo un recuento del fracaso de la guerra contra las drogas y citó como ejemplo el precio de la cocaína: “El kilo en Colombia vale U$S 1600, cuando llega a Panamá ya está en U$S 2500 en la frontera mexicana a U$S13 mil, en Estados Unidos U$S 20 mil y en el menudeo en Estados Unidos alcanza los U$S 97 mil”, señaló. El boliviano Reynaldo Molina Salvatierra, coordinador General del Programa de Apoyo al Control Social de la Producción de la Hoja de Coca coincidió: “Si no fuera un negocio productivo no habría alcanzado las dimensiones que tiene”, aseveró. Y señaló que Bolivia impulsa, como alternativa económica, “una política de incentivo a los usos lícitos de la coca, como alimentos y medicina, ya que el 18 por ciento de su composición son proteínas equiparables a las de la carne pero sin el colesterol y el ácido úrico”.
América Latina va por delante de Estados Unidos
“Las innovaciones en políticas de drogas vienen de Latinoamérica”, afirmó el experto estadounidense Ethan Nadelmann, doctor de la Universidad de Harvard y director ejecutivo de la Drug Policy Alliance (DPA) quien puso como ejemplo la Comisión Latinoamericana sobre Drogas y Democracia, porque “por primera vez ex presidentes se atreven a cuestionar la prohibición, proponen claramente de la descriminalización de la marihuana y promueven las medidas de reducción de daños”.
Nadelman resaltó los resultados de la iniciativa de las Unidades de Policía Pacificadoras en Río de Janeiro (programa para recuperar el control territorial en favelas dominadas por traficantes armados) y las medidas de inclusión social impulsadas en Medellín (Colombia), pero advirtió que “deben ser constantes y no pueden ignorar el tema de la ilegalidad de las drogas, porque mientras exista el mercado negro que financia al crimen organizado será difícil erradicar la violencia”.
Precisamente sobre las diferencias entre las políticas estadounidenses y las del resto de la región, durante la inauguración de la Conferencia en el día de ayer, el secretario nacional de justicia del Brasil, Pedro Abramovay, planteó la la relación entre narcotráfico y fronteras: “Brasil tiene una frontera seca de 15 mil kilómetros y es imposible pensar una política de drogas que ignore la relación con los vecinos. No haremos muros en nuestras fronteras porque sólo significarían asesinatos en masa”, afirmó.
También debaten jóvenes y usuarios de drogas
En la II Conferencia Latinoamericana y I Conferencia Brasilera sobre Políticas de Drogas participaron más de cuatrocientas personas, además de representantes de gobiernos y expertos de trece países de la región y funcionarios de las Naciones Unidas. Durante la jornada de hoy, en sesiones paralelas, se realizaron una reunión de Jóvenes y Políticas de Drogas y otra sobre Usuarios de Drogas. La conferencia contó con la adhesión de la OPS/OMS, ONUSIDA, la Oficina de las Naciones Unidas contra la Droga y el Delito (ONUDD), la Secretaria de Asistencia Social y Derechos Humanos de Brasil (SEASDH), el Consorcio Internacional sobre Políticas de Drogas (IDPC), el Transnational Institute (TNI), la Oficina en Washington para Asuntos Latinoamericanos (WOLA) y la Drug Policy Alliance (DPA), entre otras instituciones. Además, es patrocinada por la Fundación Open Society Institute, el Programa Nacional de ITS, SIDA y Hepatitis Viral del Ministerio de Salud del Brasil y Viva Rio.
